REPRISTINAÇÃO VERSUS EFEITOS REPRISTINATÓRIOS NA

AÇÃO DIRETA DE INCONSTITUCIONALIDADE: UM ESTUDO DE

CASO – ADIN 3.647/MA

RESUMO

O presente artigo aborda os aspectos do instituto da repristinação previsto na

Lei de Introdução ao Código Civil, de 1942, bem como dos efeitos

repristinatórios concedidos na Ação Direta de Inconstitucionalidade. Tem-se

por objetivo verificar se há diferenciações entre esses institutos. Cuida-se de

abordagem descritiva acerca do tema baseada na doutrina e jurisprudência que

apontam as eventuais diferenciações. A par disso, analisar-se-á um estudo de

caso – ADIN nº 3.647/MA – na qual foram concedidos efeitos repristinatórios a

norma anterior revogada. Conclui-se, assim, pela diferenciação entre eles, vez

que enquanto nos efeitos repristinatórios concedidos na ADIN tem-se a

reentrada em vigor de uma norma que aparentemente fora revogada – haja

vista norma inconstitucional ser norma nula; na repristinação tem-se a

reentrada em vigor de uma norma que efetivamente tinha sido revogada.

ABSTRACT

This article discusses aspects of the institute reinstate the provisions of Law

Introduction to the Civil Code of 1942, and the reincidence of ovehelmed law

effects granted the Direct Action of Unconstitutionality. One has to verify

whether there are differences between these institutes. This is a matter

descriptive approach on the subject based on the doctrine and jurisprudence

that point to any differences. In addition, it will examine a case study - ADIN

3.647/MA paragraph - in which they were granted effect repealed the previous

standard. We conclude, therefore, by differentiating between them, because

while these effects granted in ADIN has re-entry in force of a rule that

apparently had been revoked - considering rule unconstitutional the norm null;

reinstate the reentry has into force of a rule that effectively had been revoked.
